What New Mexico asks for

Each point below is followed by the state's own words, so you can check it against the source.

How to file

Only a .t2s file from Tier2 Submit is accepted, emailed to HAZMAT@DHSEM.NM.gov; no .zip, no PDF, no paper, and E-Plan is not required.

“Tier II Report must be submitted in electronic format (.t2s), we do not accept .zip files, .pdf files, or paper copies of the Tier II Form.” source
“Send the .t2s as an email attachment to HAZMAT@DHSEM.NM.gov .” source
“We do not require E-Plan submissions.” source

Fees

A state fee, by check or money order only, due March 1 and capped at $250; government agencies are exempt. Fines up to $5,000 may apply if the correct payment is not received by March 1.

“The payment must be in the form of check or money order only.” source
“If the total amount exceeds $250, then your payment will be exactly $250.” source
“Government agencies (local, tribal, state, and federal) are exempt from fees.” source
“Payments are due annually on March 1.” source
“Fines up to $5,000 may apply if payment in the correct amount is not received by March 1.” source

State-specific rule

The filing counts only once both the .t2s file and the correct payment are received.

“A facility's Tier II Report submittal is considered complete upon receipt of both the electronic submittal and payment of the correct amount.” source

The federal rule underneath

EPCRA section 312 applies to a facility that the OSHA HazCom Standard requires to keep an SDS for a hazardous chemical present at any one time at or above 10,000 lb, or at or above 500 lb or its threshold planning quantity, whichever is lower, for an extremely hazardous substance (40 CFR 370.10(a)). The report covers the previous calendar year and is due March 1 (40 CFR 370.45). Where New Mexico's rules above are stricter, they apply on top.

The full federal picture, Tier I versus Tier II, counting and penalties, is on the EPCRA Tier II hub. The list that feeds it is the chemical inventory.

HazComFast keeps each jobsite's chemical quantities next to its safety data sheets and exports the Tier II data as an Excel workbook, a CSV file and a PDF summary.
