Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and HazComFast ("HazComFast," "we," "our," or "the Company") governing your access to and use of the HazComFast website, software platform, and related services (collectively, the "Platform"). By creating an account, accessing the Platform, or using any of our services, you acknowledge that: • You have read, understood, and agree to be bound by these Terms • You have read and agree to our Privacy Policy and Refund Policy • You are at least 18 years old and have the legal capacity to enter into contracts • If acting on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms If you do not agree to these Terms, you must immediately discontinue use of the Platform and may not create an account.

HazComFast provides a cloud-based software platform designed to help businesses manage workplace safety compliance, including: • Safety Data Sheet (SDS) management and organization • GHS-compliant label generation • Hazard communication program documentation • Workplace inspection tools and checklists • Training record management • Incident and injury recordkeeping (OSHA 300 Logs) • Chemical inventory tracking • Safety analysis tools and calculators Important Limitations: • HazComFast is a documentation and recordkeeping tool, not a substitute for professional safety, legal, or regulatory consulting services • The Company does not provide legal advice, regulatory guidance, or safety engineering services • Use of the Platform does not guarantee regulatory compliance or prevent workplace incidents • Customers remain solely responsible for ensuring compliance with all applicable laws, regulations, and safety standards • The Platform provides tools and templates, but accuracy and completeness of data remains the customer's responsibility

To access the Platform, you must create an account by providing accurate, current, and complete information. You agree to: • Provide truthful and accurate registration information • Maintain and promptly update account information to keep it current • Maintain the confidentiality of your account credentials • Immediately notify us of any unauthorized access or security breaches • Accept responsibility for all activities conducted under your account • Not share account credentials with unauthorized individuals • Use strong passwords We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent or abusive behavior.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Prohibited activities include: • Violating any applicable laws, regulations, or third-party rights • Uploading malicious code, viruses, or harmful software • Attempting to gain unauthorized access to systems or data • Interfering with or disrupting Platform functionality or servers • Using the Platform for competitive analysis or building competing products • Scraping, data mining, or automated data collection without permission • Impersonating others or providing false information • Harassing, threatening, or abusing other users or our staff • Using the Platform in ways that could harm our reputation or business • Exceeding usage limits or attempting to circumvent access restrictions Violations may result in immediate account suspension or termination without refund.

Ownership: • HazComFast retains all rights, title, and interest in the Platform, including all software, features, content, trademarks, logos, and intellectual property • You retain all rights to your customer data, content, and information entered into the Platform • Neither party acquires ownership rights in the other party's intellectual property License Grant: • We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business purposes • You grant us a limited license to host, process, and display your data as necessary to provide our services • This license terminates upon account closure, subject to data retention requirements You may not: • Copy, modify, adapt, or create derivative works of the Platform • Reverse engineer, decompile, or disassemble any aspect of the Platform • Remove or alter proprietary notices or labels • Use our trademarks without prior written permission • Sell, rent, lease, or sublicense access to the Platform

Data Ownership: You retain ownership of all data, content, and information you enter into the Platform ("Customer Data"). We act as a data processor, and you remain the data controller responsible for the accuracy, legality, and appropriate use of your data. Data Use and Protection: • We will use Customer Data only to provide services as described in our Privacy Policy • We implement reasonable security measures to protect your data • We will not sell or disclose your data except as required by law or with your permission • You are responsible for maintaining backups and exporting data before account termination Data Compliance: You represent and warrant that your use of the Platform and all Customer Data: • Complies with applicable privacy and data protection laws • Does not violate any third-party rights • Includes all necessary consents and authorizations • Meets OSHA privacy requirements for employee and injury data See our Privacy Policy for detailed information about how we collect, use, and protect information.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: • Implied warranties of merchantability or fitness for a particular purpose • Warranties of title, non-infringement, or quiet enjoyment • Warranties arising from course of dealing or usage of trade • Warranties that the Platform will be uninterrupted, error-free, or completely secure • Warranties regarding the accuracy, reliability, or completeness of content You acknowledge that: • Software may contain bugs, errors, or vulnerabilities • Internet-based services are subject to interruptions and downtime • We do not guarantee 100% uptime or data availability • Compliance with regulations requires more than software tools alone • Professional judgment and expertise remain essential for workplace safety Some jurisdictions do not allow disclaimer of implied warranties, so portions of this disclaimer may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: HazComFast, its affiliates, officers, directors, employees, agents, and licensors SHALL NOT BE LIABLE FOR: • Indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or business opportunities • Business interruption or loss of goodwill • Workplace incidents, injuries, illnesses, or fatalities • Regulatory fines, penalties, or enforcement actions • Costs of procurement of substitute services • Any damages arising from use or inability to use the Platform EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Cap on Liability: In no event shall HazComFast's total aggregate liability for all claims exceed the amount you paid to HazComFast during the twelve (12) months immediately preceding the claim. Critical Acknowledgment: You acknowledge that workplace safety involves inherent risks, and software tools cannot eliminate all hazards or guarantee compliance. You remain solely responsible for implementing appropriate safety programs, training personnel, conducting hazard assessments, and maintaining compliance with all applicable regulations. Some jurisdictions do not allow limitation of liability for certain damages, so these limitations may not fully apply to you.

You agree to indemnify, defend, and hold harmless HazComFast, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: • Your use or misuse of the Platform • Your violation of these Terms or applicable laws • Your Customer Data or content you submit • Your violation of third-party rights • Workplace incidents at your facilities • Your non-compliance with safety regulations • Any negligent or wrongful conduct by you or your employees We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense. You agree to cooperate with our defense of such claims.

Termination by You: You may cancel your subscription at any time through your account settings or by contacting support@hazcomfast.com. Cancellation takes effect at the end of the current billing period. You will retain access until then. Termination by Us: We may suspend or terminate your account immediately without notice if: • You violate these Terms or our Acceptable Use Policy • Your account is used for fraudulent or illegal activities • Payment is past due or fails repeatedly • We discontinue the Platform (with 30 days' notice when possible) • We are required to do so by law or legal process • Your use threatens the security or functionality of the Platform Effects of Termination: • When a subscription ends (cancellation, non-renewal, or termination by us for non-payment), your organization's account enters a read-only period of ninety (90) days. During that period you and your users can still sign in, consult your records, and export them in full, but cannot create or modify data. • Safety Data Sheets, the emergency mode, and the export of your records remain available during the read-only period under every billing state; we do not condition access to these regulatory records on payment. • You will be billed for services provided through the termination date. • After the read-only period, your data may be deleted in accordance with our data retention policies. Provisions regarding intellectual property, liability, and disputes survive termination. • Termination by us for a violation of these Terms or of the Acceptable Use Policy may take effect immediately; the read-only export period still applies to your regulatory records unless the law requires otherwise. Data Export: A full export of your records (OSHA logs, training records, permits, SDS library and their attachments) is available from your account settings at any time, including during the read-only period. You are responsible for downloading the export you wish to retain before the read-only period ends. We are not responsible for data loss after that period.

Modifications to Terms: We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting with an updated "Last Updated" date. For material changes that significantly affect your rights: • We will provide at least 30 days' notice via email or Platform notification • Continued use after changes take effect constitutes acceptance • If you disagree with changes, you may cancel your subscription Modifications to Services: We may modify, update, or discontinue features at any time. We will make reasonable efforts to notify users of significant changes. We are not liable for modifications, suspensions, or discontinuation of services, except as required by law.

Governing Law: These Terms shall be governed by and construed in accordance with applicable law. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Dispute Resolution: Before initiating formal legal proceedings, we encourage you to contact us at support@hazcomfast.com to attempt good-faith resolution. If informal resolution fails, disputes shall be resolved in accordance with applicable law.

Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and HazComFast regarding the Platform and supersede all prior agreements and understandings. Severability: If any provision is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be modified to reflect the parties' original intent. No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision. Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms to affiliates, successors, or acquirers. Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, acts of war, internet outages, or third-party service failures. Notices: Legal notices must be sent to support@hazcomfast.com. We may provide notices via email, Platform notifications, or website postings. Relationship: These Terms do not create a partnership, joint venture, employment, or agency relationship. Export Compliance: You agree to comply with all applicable export control and trade sanctions laws.
