Arkansas Tier II reporting: how and where to file

Arkansas takes Tier II only through HazConnect; paper forms are refused. Reports are due, and fees paid, by March 1 each year; late fees are assessed after that. For the 2025 reporting year: $50 for the first reportable chemical and $10 for each additional one, up to $1,000 per facility. Federal, state, county and municipal facilities pay no fee but must report in full.

What Arkansas asks for

Each point is followed by the words of the state's own page.

How to file

Arkansas takes Tier II only through HazConnect; paper forms are refused.

“Tier II reports must be submitted electronically through HAZCONNECT. No paper forms will be accepted.” source

How to file

Register in HazConnect as a "Reporting Facility/Business User". Only one user account can be linked to a facility, so everyone who works on its report shares that account.

“Facilities need to register as a “Reporting Facility/Business User”.” source
“NOTE: Only one user account can be associated with a facility, so if there are other persons within your organization that provide input on your Tier 2 reports they must manage that information through the same user account.” source

Deadline

Reports are due, and fees paid, by March 1 each year; late fees are assessed after that.

“Per Arkansas Law, Tier 2 Reports must be submitted and fees paid by March 1 of each year or late fees will be assessed.” source

Fees

For the 2025 reporting year: $50 for the first reportable chemical and $10 for each additional one, up to $1,000 per facility. Federal, state, county and municipal facilities pay no fee but must report in full.

“$50.00 for the first reportable chemical and $10.00 or each additional chemical. A maximum of $1,000 per facility is assessed.” source
“TIER 2 Reporting Fee Structure for 2025 Reporting Year.” source
“Federal, State, County and Municipal Facilities – No fee required , but full reporting is mandatory.” source

Fees

Each oil and gas lease counts as a facility, with its own Tier II report and a $200 fee.

“On October 9, 1997, the State Emergency Response Commission declared each lease (as recorded with the Oil and Gas Commission) to be recognized as a ‘facility’ thus, requiring a Tier II report and fee to be filed for each lease/facility. The fee is $200.00 per lease/facility.” source

State thresholds

Arkansas uses the federal thresholds: 10,000 pounds for hazardous chemicals; 500 pounds or the threshold planning quantity, whichever is less, for extremely hazardous substances.

“Extremely hazardous substances (EHS): 500 lbs. or the threshold planning quantity (TPQ), whichever is less.” source
“Hazardous chemicals: 10,000 lbs.” source

Who gets the report

ADEM is the state's central repository: it passes the reports to the LEPCs and fire departments.

“Facilities electronically submit Tier II reports each year, and ADEM distributes them to Local Emergency Planning Committees (LEPCs) and fire departments statewide.” source

The federal rule underneath

EPCRA section 312 applies to a facility that the OSHA HazCom Standard requires to keep an SDS for a hazardous chemical present at any one time at or above 10,000 lb, or at or above 500 lb or its threshold planning quantity, whichever is lower, for an extremely hazardous substance (40 CFR 370.10(a)). The 10,000 lb figure is the general case: at a retail gas station the thresholds are 75,000 gallons of gasoline and 100,000 gallons of diesel fuel (all grades combined), and they apply only to fuel in tanks entirely underground that met every applicable underground storage tank requirement at all times during the preceding calendar year (40 CFR 370.10(a)(2)(ii) and (iii)); otherwise the general threshold applies. The report covers the previous calendar year and is due March 1 (40 CFR 370.45). Below every threshold, a request still has to be answered: when your LEPC, SERC or fire department asks for Tier II information, the threshold is zero and the information is due within 30 days (40 CFR 370.10(b), 370.45(b)). Where Arkansas's rules above are stricter, they apply on top.

The full federal picture, Tier I versus Tier II, counting and penalties, is on the EPCRA Tier II hub. The list that feeds it is the chemical inventory.

HazComFast keeps each jobsite's chemical quantities next to its safety data sheets and exports the Tier II data as an Excel workbook, a CSV file and a PDF summary.

Keep the chemical list behind your Tier II report current

Tier II is an EPCRA filing to your state and local agencies, not an OSHA citation. The same chemical inventory feeds your SDS binder and the report, so keep it in one place.
