On October 23, 2022, a worker climbed into a barley germination tank on a portable ladder because the turning auger arm had stopped, intending to shovel wet germinating grain away from the vertical helixes. He told a coworker he could not breathe, lost consciousness and died. OSHA proposed $87,501 across a full permit-space group, paragraphs (d)(2), (d)(3), (d)(4), (d)(6), (d)(13), (j)(4) and (k)(1) of 1910.146, plus respiratory, lockout, electrical, machine-guarding and hazard communication items. The employer contested, and most of it was deleted. What stayed is the first duty in the chain: 1910.146(d)(2), identify and evaluate the hazards of permit spaces before employees enter them, at $9,000, with the case closing at $20,000 in total.
