Who the Nevada OSHA plan covers

The Nevada State Plan applies to private sector workplaces in the state with the exception of:

  1. Maritime employment, including shipyard employment, marine terminals, and longshoring;
  2. Contract workers and contractor-operated facilities engaged in United States Postal Service (USPS) mail operations;
  3. Contractors and subcontractors on land under exclusive federal jurisdiction;
  4. Private-sector employment on military facilities and bases;
  5. Employment on Indian land;
  6. All working conditions of aircraft cabin crewmembers onboard aircraft in operation; and
  7. Any hazard, industry, geographical area, operation or facility over which the state is unable to effectively exercise jurisdiction for reasons not related to the required performance or structure of the plan.

The Nevada State Plan also applies to state and local government employers. It does not apply to federal government employers, including the United States Postal Service. Federal OSHA covers the issues not covered by the Nevada Plan. In addition, Federal OSHA retains enforcement of the anti-retaliation provision of the Occupational Safety and Health Act of 1970, Section 11(c), 29 USC 660(c), with respect to the private sector. Nevada OSHA also investigates private and state and local government workplace retaliation cases under a provision analogous to Section 11(c).

The standards Nevada writes for itself

Nevada OSHA has incorporated most OSHA standards by reference. Nevada OSHA has adopted the following unique standards:

General industry

  • Safety Programs
  • Cranes
  • Asbestos
  • Explosives
  • Ammonium Perchlorate
  • Photovoltaic System Installation
  • Sanitation
  • Hazard Communication

Construction

  • Cranes
  • Steel Erection
  • Asbestos

OSHA's page names the standards; the binding text is the state's own (Nevada OSHA website). Where a federal standard applies, the state enforces it as it adopted it.

Hazard communication in Nevada

The rule

Nevada OSHA state plan: unique general-industry standards

OSHA lists hazard communication among the standards Nevada writes for itself in general industry, so a Nevada employer reads the Nevada rule and not 1910.1200 by that number. The Nevada rule text itself has not been read for this entry.

What the state text says

OSHA's Nevada state-plan page records that "Nevada OSHA has incorporated most OSHA standards by reference" and lists Hazard Communication among the standards Nevada writes for itself in general industry, alongside safety programs, cranes, asbestos, explosives, ammonium perchlorate, photovoltaic installation and sanitation. So the Nevada rule is the one enforced, and the federal text is not a safe substitute. This is OSHA's record of the plan rather than a quotation from a Nevada regulation.

Working under the Nevada OSHA plan, in five steps

  1. Step 1

    Check that the jobsite is under the State Plan

    OSHA lists 7 exceptions to Nevada OSHA's private-sector coverage, starting with maritime employment, including shipyard employment, marine terminals, and longshoring. Work under an exception falls to federal OSHA.

  2. Step 2

    Read the Nevada standards that touch your trade

    For construction, OSHA's list names Cranes, Steel Erection, Asbestos. Read the state text for each before you build the site plan.

  3. Step 3

    Set your HazCom program to the state rule

    Nevada OSHA state plan: unique general-industry standards is the rule to read before you set compliance dates. OSHA lists hazard communication among the standards Nevada writes for itself in general industry, so a Nevada employer reads the Nevada rule and not 1910.1200 by that number.

  4. Step 4

    Know the penalties and the contest path

    Nevada OSHA conducts informal conferences in an effort to resolve contested cases. The citation states the deadline to contest, and the state review body is described under Penalties and appeals.

  5. Step 5

    Use the free consultation program

    Safety, Consultation & Training Section (Department of Business & Industry - Division of Industrial Relations) offers on-site consultation, separate from enforcement.
