Frequently asked questions
How long do I have to fix a cited hazard?
Until the abatement date on the citation. If you can't finish in time, file a petition for modification of abatement date (PMA) with the Area Director no later than the close of the next working day after that date. It must show a good-faith effort, the extra time needed, the reason, and how employees are protected in the meantime (29 CFR 1903.14a).
Do I have to prove I fixed it?
Yes. Within 10 calendar days after each abatement date you certify the fix in writing: date, method, and a statement that affected employees were told (29 CFR 1903.19(c)). Willful and repeat items, and serious items the citation flags, also need documents such as photos or receipts (1903.19(d)).
Can I contest a citation?
Yes. The written notice must be postmarked within 15 working days of receiving the notice of proposed penalty (29 CFR 1903.17(a)). For items contested in good faith, the abatement period does not start until the Review Commission's final order (29 U.S.C. 659(b)).
