Whose HazCom rule applies in Utah?

Utah takes the federal hazard communication text. It is one of 12 full State Plans that do, out of 22.

Utah takes the federal text as a dated CFR edition (July 1, 2025) plus three separately named Federal Register notices, among them the January 15, 2026 HazCom extension, so Utah employers follow the federal HCS 2024 dates.

Rule: Utah Admin. Code R614-1-4

Utah incorporates "29 CFR 1910.6 and 1910.21 through the end of part 1910, of the July 1, 2025, edition" (R614-1-4(A)(3)), a fixed annual CFR edition rather than an "as amended" reference, and names three Federal Register notices separately: "Hazard Communication Standard; Corrections" of January 8, 2026 (91 FR 562-598), "Hazard Communication Standard" of January 15, 2026 (91 FR 1695-1696, the date extension) and "Hazard Communication Standard; Corrections" of February 13, 2026 (91 FR 6760). Naming the January 15, 2026 notice puts Utah on the federal HCS 2024 dates. Until this amendment the rule named the July 1, 2024 edition, which went to print before HCS 2024 took effect on July 19, 2024 and still carried the 2012 text. The rule page on the Utah Division of Administrative Rules shows an effective date of May 22, 2026 and was read on 2026-10-06.

FAQ: OSHA in Utah

▸Is Utah a federal OSHA or state-plan state?

Utah is an OSHA-approved State Plan covering both private and public employers. Private-sector construction employers in this state answer to the state plan, not federal OSHA. Its standards must be at least as effective as federal OSHA, and some state plans set higher penalty maximums.

▸What are the maximum OSHA penalties in Utah in 2026?

Utah sets its own maximums: Utah (Utah Code §34A-6-307, effective May 7, 2025) sets its own statutory maximums just below the federal amounts: serious up to $16,131; willful/repeat up to $161,323, with a $11,518 minimum per willful violation. Failure to abate runs up to $16,131 per day. Serious violations carry up to $16,131 each (other-than-serious the same), and Willful or Repeat violations up to $161,323 each. Failure-to-Abate runs up to $16,131 per day. These 2026 amounts are unchanged from 2025 (no inflation adjustment).

▸Does Utah have its own OSHA plan?

Yes. Utah operates a full state plan administered by Utah Occupational Safety and Health Division (UOSH), covering both private and public employers. State plans must be "at least as effective" as federal OSHA and may set higher penalties.

▸How many OSHA construction citations does Utah see?

In FY2025 (October 1, 2024 – September 30, 2025), OSHA construction inspections in Utah produced 269 citations across 133 inspections, with $334,644 in penalties at current amounts (OSHA Frequently Cited Standards, NAICS 23, Construction). Because Utah runs its own State Plan, these are the state agency's own figures.

▸Did OSHA penalties go up in 2026 in Utah?

No. The 2026 federal maximums are unchanged from 2025 because the required CPI adjustment was not published (OMB Memo M-26-11), so the 2025 amounts carry forward unchanged. 29 CFR 1903.15 identifies January 15, 2025 as the effective reference for these figures. Utah's state-set maximums are tracked separately by Utah Occupational Safety and Health Division (UOSH). Do not treat 2026 as an increase.

▸Which OSHA violations are cited most in Utah construction?

Utah Occupational Safety and Health Division (UOSH) cited 29 CFR 1926.501 most often in Utah construction in FY2025, 63 times (OSHA Frequently Cited Standards). Nationally, federal OSHA cited fall protection (29 CFR 1926.501) most often in construction in FY2025, 6,772 times (OSHA Frequently Cited Standards).
