What federal OSHA is looking for, region by region

Under federal jurisdiction the standards are the same everywhere. What changes is which hazards an office has decided to go out and inspect for — published as numbered emphasis directives.

Most OSHA inspections of a construction site are not responses to a complaint or an accident. They are programmed — the office selects the site from a list built around a Regional or Local Emphasis Program. Each of those programs is a signed directive with a number, an effective date and a stated scope, and it names the hazards and industries the office will go looking for.

That is the honest answer to “why does enforcement feel different in Texas than in Rhode Island?” when 29 CFR is identical in both. Below are the 56 directives currently carried on this site, grouped by the office that issued them. A directive's scope decides which states it reaches, and it is quoted verbatim — an office list is often narrower than the region it sits in, which is exactly where summaries of these programs go wrong.

Regional Local Emphasis Program for Residential Construction

“This instruction applies to Federal OSHA, Boston Region jurisdiction.”

Residential construction is scheduled for programmed inspection across the whole Boston region, and the directive names the industries it targets by NAICS: 236115 and 236116 for new single-family and multifamily housing, and the 238 specialty trade codes including framing, roofing, siding, masonry and drywall. A residential framing or roofing crew here is not waiting for a complaint to be inspected; it is on a targeting list.

Regional Local Emphasis Program for Powered Industrial Trucks

“This instruction applies to Boston Region Federal Area and District Office jurisdictions.”

Forklifts have their own programmed-inspection program across the Boston region's federal area and district offices. Operator training and evaluation records under 1910.178(l) are the first thing asked for, and the program runs alongside the region's residential construction and crane programs rather than instead of them.

Regional Local Emphasis Program Cranes in Construction

“This instruction applies to Federal OSHA, Boston Region jurisdiction.”

Cranes in construction carry a separate regional program here. It matters on scaffold and fall-protection work because a crane on site makes the whole project a candidate for a programmed inspection, and an inspection opened on the crane does not stop at the crane.

Regional Local Emphasis Program for Noise in the Workplace

“This instruction applies to Federal OSHA, Boston Region jurisdiction.”

Noise carries its own programmed-inspection program across the Boston region. It is the program most likely to put a hearing conservation file and a PPE hazard assessment in front of an inspector in these five states, and it runs alongside the region's residential construction, crane and forklift programs rather than instead of them.

Local Emphasis Program for the Seafood Processing Industry

“This instruction covers Region I and includes employers under Federal OSHA jurisdiction only.”

Seafood processing is targeted by NAICS 311710, 311711 and 311712, plus 424460 for fish and seafood merchant wholesalers, and the directive names the hazards it goes after: machine guarding, lockout/tagout, confined space, and the ammonia refrigeration systems that run the plant. It records why: exposure to ammonia and cooling system hazards produced three general duty clause violations in the region, one willful serious and two repeat serious, plus a hazard alert letter. Anhydrous ammonia is what ties this to hazard communication as well as to confined-space entry.

Noise is programmed across every area office in the New York region, under a directive effective December 5, 2024. Hearing protection is selected, provided and used under the PPE standard, so a noise inspection is in practice a PPE inspection with a dosimeter attached.

Regional Emphasis Program – Construction Work Sites – Local Targeting

“This instruction applies to all Region II Area Offices.”

Region II targets construction worksites locally rather than by a single hazard, which means the inspection is scheduled because of where and what the project is, not because a specific violation was reported. The program runs to September 30, 2028. New Jersey and New York both operate State Plans covering public employees only, so private construction in both states sits under this federal program.

Regional Emphasis Program – Health High Hazards – Top 50

“This instruction applies to all Region II Area Offices.”

Region II targets health hazards by ranking: a top-fifty list drives programmed health inspections across every area office. For an employer in New Jersey or New York, the chemical side of the program (classification, safety data sheets, exposure assessment and respiratory protection) can be the reason an inspector arrives.

Refuse handling and hauling is programmed across every Region II area office. It reaches hazardous energy control because the injuries it targets come from compaction and baling equipment (packer blades and balers that must be locked out before anyone clears a jam), and it reaches protective equipment through the hazard assessment that waste handling calls for.

Regional Emphasis Program for Fall Hazards in the Construction Industry

“This Instruction applies to all Area Offices in Region III.”

Fall hazards are the named target across every area office in Region III, and the directive says why in its own background: the Bureau of Labor Statistics recorded 393 deaths from falls to a lower level in construction in 2021, up from 321 in 2018. The program runs to September 30, 2028. A fall-protection citation in this region is more likely to come from a scheduled inspection than from a complaint.

Regional Emphasis Program for Demolition Activities and Gut Rehabilitation

“This Instruction applies to all worksites located within the jurisdiction of the Region III, Philadelphia, Charleston, Wilkes-Barre, Erie, Allentown, Baltimore/Washington, Harrisburg, and Pittsburgh Area Offices.”

Demolition and gut rehabilitation carry their own programmed-inspection program, aimed at the destruction and renovation of fixed buildings and structures. The area offices are named individually (Philadelphia, Charleston, Wilkes-Barre, Erie, Allentown, Baltimore/Washington, Harrisburg and Pittsburgh), so the reach is Pennsylvania, West Virginia and the District through the Baltimore/Washington office.

“This instruction also applies where powered industrial trucks are used in other warehousing, storage, and distribution yard operations not in a targeted NAICS code.”

Region III programs warehousing by NAICS (424410, 424470, 424490 and 424810 on the wholesale side, 493110 and 493120 for general and refrigerated warehousing), then widens the net in its own words: it also applies wherever powered industrial trucks are used in warehousing, storage and distribution yard operations outside those codes. A yard with a forklift in it does not escape by having the wrong industry code.

“This instruction applies to all Atlanta Region Area Offices.”

Powered industrial trucks are programmed for inspection across every Atlanta region area office. Worth knowing alongside it: the region's construction LEP, ATL-CPL-04-00-008, is titled simply "Local Emphasis Program for Construction" but applies only to federal-jurisdiction worksites in North Carolina and South Carolina. It does not reach private construction in Florida or Georgia.

Maritime work is programmed across the Atlanta region's area offices in Florida and Georgia. Confined spaces are the reason it belongs here: tanks, voids and cofferdams on a vessel are entered under the shipyard competent-person and marine chemist regime rather than under 1910.146, and knowing which rule applies to the space you are about to enter is the first question on a waterfront job.

“This instruction applies to Birmingham, Mobile, Jackson and Nashville Area Offices.”

Maritime inspections are programmed through the Mobile office on the Alabama coast and the Jackson office in Mississippi, under a directive effective April 22, 2025. Shipyard work has its own confined-space rules, Part 1915 Subpart B rather than 1910.146, and this program schedules inspections of that work in these two states.

High noise in manufacturing is the Dallas region's newest emphasis program, effective July 7, 2026. Hearing protection is selected and used under the PPE standard, and the operations that generate the noise usually generate an airborne exposure too, so a noise inspection can reach the respiratory program as well.

Construction across the whole of Oklahoma and Texas is programmed for inspection, targeting NAICS 236, 237 and 238: building construction, heavy and civil engineering, and the specialty trades. Cleaning transportation tanks is programmed by name across Arkansas, Louisiana, Oklahoma and Texas. It is the single directive that puts all three chemical standards into one inspection: the residue left in the tank is a hazardous chemical the employer must have classified and communicated, the tank itself is a permit-required confined space, and going in means a respiratory protection program with the right cartridge for what was carried.

Regional Emphasis Program for Fall Hazards in Non-Construction

“This Notice applies to all worksites in Arkansas, Louisiana, Oklahoma, and Texas, and those worksites in New Mexico that are under Federal OSHA jurisdiction.”

This one is worth reading for what it is not. Fall protection outside construction is programmed separately across the same four states, which means a fall in a warehouse, a plant or a yard is judged against the general industry walking-working surfaces rules in Subpart D, not against 1926.501, and the trigger heights, criteria and citation all differ. Knowing which side of that line the work falls on is the whole question when a job mixes construction and maintenance.

Kansas City Regional Office7 programs

Regional Emphasis Program (REP) on Falls, Scaffolds, and Electrocutions from Overhead Power Lines in Construction

“This instruction applies to Region VII Area Offices.”

The directive states its own weight: the predecessor program "accounted for 44% of all safety inspections, 54% of all construction inspections, and 26% of all inspections" across Region VII in fiscal years 2019 to 2024. It also records that 28% of fatal and catastrophic federal enforcement incidents in the region between October 2018 and June 2024 were in construction. In Kansas, Missouri and Nebraska, more than half of all construction inspections come from this one program.

“This Instruction applies to general industry and construction establishments in industries that commonly have occupational noise hazards within the jurisdiction of all Federal Area Offices in Region VII.”

Region VII's noise program is unusual in naming construction alongside general industry in its own scope, so a Kansas, Missouri or Nebraska jobsite is inside it, not only a plant. The Denver region targets street and highway work zones by NAICS 237310 (highway, street and bridge construction) to reduce serious injuries and fatalities during work zone activity. Regional Emphasis Program for Heat Illness

“This Instruction applies to Federal enforcement activities in Region IX.”

Region IX runs a heat illness emphasis program covering federal enforcement across the region, alongside a separate regional policy on heat illness prevention. Find the office that covers where you are building, read its directives, and check the scope sentence against your NAICS code and your actual scope of work. If you fall inside one, a programmed inspection is not bad luck — it is the published plan, and the hazards named in the directive are the ones an inspector arrives already intending to look at. Emphasis programs expire and are renewed, so the effective and expiry dates above matter as much as the subject line.
